Baguio City to issue orders against 40 businesses for smoking ordinance breaches

BAGUIO CITY — The city government will issue show-cause orders to 40 business establishments in the Summer Capital found to have repeatedly violated the city’s Smoke-Free Ordinance.

Mayor Benjamin Magalong, who chairs the Smoke-Free Baguio Task Force, said the show-cause order will be issued by the Permits and Licensing Division of the City Mayor’s Office as part of due process.

The establishments will be ordered to explain why they should not be meted the penalty of temporary closure of operations for violating City Ordinance 34, Series of 2017, multiple times.

The erring businesses are composed of 20 night restaurants and bars, nine sari-sari stores, five restaurant-cafes, three dry goods stores, two entertainment centers, and one memorial chapel.

Under Ordinance 34, Series of 2017, establishments that fail to enforce the ordinance, allow smoking without an authorized designated smoking area, or tolerate violations face fines of up to P5,000.

Repeat offenders or establishments that accommodate unauthorized or illegally built smoking areas risk the suspension or revocation of their business licenses and permits.

Passed in 2017, the ordinance prohibits the use, sale, distribution, and advertisement of cigarettes, vapes, and other tobacco products in all public places, enclosed spaces, public utility vehicles, streets, accommodation establishments (including apartments and hotels), entertainment venues, and areas within 100 meters of parks, schools, and ­churches.
